Please read these terms and conditions carefully before using the Ikon Shop website. This website is owned and operated by Ikon Gallery Limited, Ikon Gallery,1 Oozells Square, Brindleyplace, Birmingham, B1 2HS. 

Orders

All orders are subject to acceptance and product availability. Ikon aims to ensure that the pricing of products on the website is correct at all times.

Acknowledgement of Order

When you have completed your order, you will be sent a confirmation email. It will state what the products are, the cost (including postage, packaging and VAT if applicable), delivery information and invoice details. If your order has been unsuccessful you will be made aware of the reason why.

Availability

Availability information is listed on each individual product. If Ikon has insufficient stock to deliver the goods you have ordered, Ikon will inform you by email at the address given  and any sum, which may have been debited from your credit card, will be credited to you within 30 days of the date of your order.

Pricing and Currency

The total cost of your order reflects the price of the items ordered plus a shipping and handling charge for packaging and postage. You will be contacted to confirm the status of your order. All products are priced in pounds sterling (£) and prices include UK Value Added Tax where applicable. Ikon reserves the right to change prices at any time. Online prices of some goods may differ from those in the actual shop.

Validity

By ordering a product you accept Ikon’s terms and conditions, which can be subject to change at any time, and it is your responsibility to check them regularly before ordering products in case there are any changes.

Data Protection

Ikon will never make your personal details available to other companies for marketing purposes. Ikon will keep a record of your address details with the intention of sending your order.

Payment

Ikon accepts all major credit and debit cards. Payment can also be made by card in person or over the telephone +44 (0)121 248 0711. All credit and debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to us, your order will not be accepted and Ikon will not be liable for any delay or non-delivery. 

Ikon uses the 3D Secure system to prevent credit card fraud. 

3D Secure is a payment verification protocol used by major credit card companies, branded as ‘MasterCard Secure Code’ and ‘Verified by Visa’. Depending on the card issuer, 3D Secure is an opt-out option or a required service for using the card to make internet purchases. Cards registered with 3D Secure could require the user to enter a Personal Identification Number (PIN) code. This is not the same PIN code issued with the card. 3D Secure verifies card details, offering the country of issue and other card holder details to the proposed vendor. Depending on the information returned by the 3D Secure system, Ikon can elect to send the goods as requested, deliver goods only to the card holder’s address (instead of a nominated address) or in a very limited number of cases, we can decide to cancel an order. The system is completely automated and we do not store any of the data provided by the 3D Secure system.

Ikon does not store any credit card details or other sensitive information at www.ikon-gallery.org.

Delivery

All deliveries are made by Royal Mail or Parcelforce depending on the shipment and delivery address. All items are usually dispatched within 5 working days after an order has been placed. Ikon aims to deliver within 3-5 working days for UK orders, within 7-14 days for European destinations and within 12-24 days for the rest of the world.

Shipping prices are calculated at checkout from the weight and dimensions of the package to be delivered and your chosen delivery address.

Your Agreement

You warrant that the information given on your order form is complete and accurate.

Profits

All profits from Ikon Shop support Ikon’s charitable artistic and educational programme.

Our Contract

A legally binding contract between you and Ikon will be formed upon confirmation receipt of the dispatch of your order. This email confirmation shall represent Ikon’s legal acceptance of the offer you made to purchase the product(s) when you completed your order. If Ikon confirms to you that some but not other products that you have ordered have been dispatched, the product(s) that have not been dispatched will not form part of the contract. In the event of any change, for example, in price or expected delivery date between completion of your order and contract formation, Ikon shall inform you and you shall at that point have the right to either (i) accept such change (in which case your email reply will represent a new offer which Ikon will accept upon notification of dispatch) or (ii) reject such change (in which case your email reply will represent a withdrawal of your order, or the relevant part of your order as the case may be).

Guarantee

You have the right to cancel your order within 7 working days starting from the day after the goods have been received. A refund for the full amount of the order will be paid back to you within 30 days of the cancellation of the order. Delivery costs are non-refundable.

Damaged Goods or Incorrect Deliveries

Purchased goods must be stored by you in appropriate conditions. If you do not store them in appropriate conditions, Ikon cannot be held responsible for faults or problems that arise as a result. Any claim by you in respect of any shortages and/or defects in the goods must be notified to Ikon by you within 7 days of the delivery date, stating the nature of the shortage/defect and quoting the invoice number. Failure to notify Ikon will deem you to have accepted the goods.

In addition, for defective goods, Ikon will refund you reasonable costs incurred for postage of the goods, but shall have no further liability to you. If you do not notify Ikon accordingly, Ikon shall have no liability for any defects and you shall be bound to pay for the goods.

Force Majeure

Ikon shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond its reasonable control.

Limitation of Liability

Although Ikon takes every care to ensure accuracy; it makes no warranties as to the accuracy of the information placed on the website. The extent of Ikon’s liability for any breach of these terms and conditions shall be limited to the value of the goods ordered by you in the relevant transaction; however nothing in these terms and conditions shall exclude or limit Ikon’s liability for death or personal injury as a result of Ikon’s negligence.

Invalidity of Terms and Conditions

If for any reason part of these terms and conditions is unenforceable, the validity of the remaining terms and conditions shall not be affected.

Governing Law and Jurisdiction

These terms shall be governed by and construed in accordance with English Law and agree to submit to the exclusive jurisdiction of the English courts.
